We recommend careful reading of all the following terms and conditions regarding sales and delivery. This website, www.brellum.swiss, is owned and operated by Brellum Swiss Watchmaking, S.Muller, CH - 2900 Porrentruy. These Terms of Use are subject to change by us at any time, effective when posted on the Website. Your continued use after such notice will constitute acceptance by you of such changes.

General

These terms and conditions of sale and delivery apply to the sale and delivery of products offered on www.brellum.swiss. By ordering one of our products, you expressly accept the provisions outlined below. To be deemed valid, any modification and every addendum to the general terms and conditions of sale and delivery must be expressly agreed in writing, including possible changes to these provisions.

Brellum Swiss Watchmaking is the exclusive owners of all designs, products, information and all copyrights, trademarks and other intellectual property or proprietary rights contained on or used in connection with the Website. Except as set forth herein or authorized by Brellum Swiss Watchmaking, you agree not to copy, distribute, modify or make derivative works of any materials without the prior written consent of the owner of such materials or a legal right to do so.

Capacity to accept these terms of use

You hereby confirm that you fulfil at least one of the following conditions, that you are over the age of 18, or that you are an emancipated minor, or that you have legal consent from a parent or guardian and that you are entirely able to subscribe to the terms, conditions, duties, claims, representations and warranties stipulated in these conditions of use, as well as respecting and complying with these conditions of use.

Order

Clients can order using the “Purchase” tab. In this event, they will have to choose the way of payment, by transfer or by credit card (Stripe). In line with the instructions provided online, they will be required to complete a form requiring details with regard to their identity and in particular their last name, first name, telephone number, postal, email and delivery addresses. Contractual information will be sent in a confirmation per email under 5 working days.

Clients also have the option of ordering directly by email from customer@brellum.swiss by specifying the model, serial number, quantity and personal information (last name, first name, delivery address, billing address, e-mail and telephone number). An invoice containing the relevant bank details will be dispatched. Delivery will take place as soon as payment has been credited to the Brellum Swiss Watchmaking bank account.Brellum Swiss Watchmaking retains the right of ownership of products until full payment has been received. No delivery under any circumstances will be made without full payment.

Prior acceptance of the terms and conditions of sale

Every order placed on the site requires the express prior consultation of the terms and conditions of sale by the client by means of a box to be ticked on the acceptance window appearing during the order placement process prior to any payment. The present conditions of sale may be modified at any time. Nevertheless, the conditions of sale applicable to an order are those in effect on the day of placement of the relevant order.Contracts in our online shop can only be made in French or English, if there are differences in terms of language, French prevail.

Product description

Products available for sale on the site are represented by high-quality photographs and accompanied by a description of their essential characteristics. Products are described and presented with the greatest possible accuracy. Nevertheless, due to computer technology, articles delivered may sometimes present minimal differences, notably with regard to color, in comparison with photographs on the website.

Price, shipping costs and payment

Prices displayed on the website are in Swiss francs (CHF). Shipping costs are complimentary. Costs related to processing the order may on the other hand be invoiced at the time of ordering through Credit Cards (Stripe). Prices indicated on the site are indicative and may be changed at any time. Prices invoiced are those in effect on the date of confirmation of the order.

For countries all over the world to which Brellum Swiss Watchmaking agrees to deliver products, orders are payable in Swiss francs (CHF). Should clients’ local currency differ from the currency in which prices appear on the website, the client’s bank will apply the exchange rate in effect on the day of the order (unless the exchange rates differ from those applied by the client’s own bank).

For deliveries that are subject to Swiss law, Brellum Swiss Watchmaking invoices and collects VAT at the current rate. For sales abroad, the contract only states the price of the object in question. The purchaser is responsible for paying VAT, customs duties and any possible other taxes in effect in the country of delivery. In order to avoid any errors occurring, Brellum Swiss Watchmaking recommends that purchasers obtain all relevant information from the appropriate authorities. The seller takes no responsibility for non-compliance on the part of the purchaser with his or her legal obligations with regard to statutory requirements. Nor shall it be held liable for any reimbursement whatsoever of an object confiscated by the authorities of a delivery country or in the event of circumstances involving fortuitous events such as wars, riots, epidemics, strikes etc.

Delivery

Delivery will be made to the delivery address indicated by the client at the time of ordering. Shipping of parcels will be done in a secure manner via the Swiss Postal Service or, in the event of a foreign order, through an approved carrier.Parcels must be signed for on delivery. These become the property of the purchaser once the latter has signed, confirming that he or she has received the parcel and checked that the latter is not damaged in any way. Should there be any signs of damage, the parcel must be refused and returned to the Swiss Postal Service or approved carrier.In this event, clients are requested to contact Brellum Swiss Watchmaking with immediate effect, either in writing or by email at customer@brellum.swiss stating their refusal and the reason therefore.

Only articles that qualify under the terms of the warranty may be returned for exchange. Articles must be returned intact and complete in their original packaging (with the labels stating their references), accompanied by the delivery note, within five days of reception of your parcel. Shipping costs related to the return are at your own expense.

Transfer of ownership

Brellum Swiss Watchmaking reserves full rights to products sold until the entire amount owed by the customer within the framework of his or her order has been received. Nevertheless, risks related to loss, theft or destruction incurred during the period from delivery to transfer of ownership are at the client’s expense. Only the original owner of the goods may lay claim to these general conditions of sale.

Warranty

All products for sale on www.brellum.swiss benefit from a two-year warranty as of the date of delivery. If, during this period, the article delivered turns out to be defective, you are entitled to request repair by email from the following address: customer@brellum.swiss. Conditions of application as well as the list of exceptions that are not covered by the warranty can be found in your certificate of warranty.

The warranty does not apply to certain cases:

Damage caused to external parts or to the movement resulting from abnormal usage, accidents, shocks, blows or accidental falls, improper, incorrect and excessive handling or operation, including dents, marks from blows, scratched or broken crystals, a scratched case, a twisted crown or push-piece, exposure to powerful magnetic fields and to corrosive products or solvents, detergents, perfumes, cosmetic products, prolonged exposure to the sun, etc. Ageing, normal wear of crystals (scratches, splinters), of steel or its finishes, alterations of the color of leather or rubber straps or steel bracelets. Any deterioration resulting from repairs not conducted by one of our dealers or at one of our workshops as well as opening, repair or maintenance done by an unauthorised person. Wear and tear of leather, rubber or fabric straps or steel bracelets. Theft or loss of the watch or parts thereof. Incidental or consequential damage resulting from use of or inability to use this watch. Water-resistance is guaranteed on condition the crystals, bezel, case-back, body and crown are not damaged in any way.

For any repairs or maintenance outside of this two-year warranty period, we suggest you contact our customer service department or our official agents, the latter being particularly up-to-date with regard to our techniques. Finally, we are in no way responsible for “remedying” any apparent defects that buyers think they perceive but which do not correspond to any actual flaw.In order to benefit from this international warranty, the duly dated warranty card registered by us is required.

Data protection

Brellum Swiss Watchmaking uses information and personal details provided by the client while using www.brellum.swiss website to the extent that the latter are required for the supply of related services, such as processing an order, product delivery and settlement proceedings, or in the performing of statutory duties, or in the event of the client having given his or her consent.

Safeguard clause

Should certain provisions of these conditions of sale and delivery become null and void, invalid or inapplicable, the validity or legal enforceability of the other provisions remains unchanged. Should a situation of this nature occur, the parties will agree to a valid and enforceable provision which will be as close as possible from an economic standpoint to the provisions declared null and void, invalid or inapplicable.

Applicable law and place of jurisdiction

The terms and conditions are subject to Swiss law. Any litigation related to these conditions of sale and delivery will be settled by the common courts of the Canton of Jura, Switzerland
